Terms of Service

The rules for using OutGeek: accounts, plans, job posts, paid services, events and voting. Each section starts with a short version. The details underneath are the part that counts. Section 17 includes an arbitration agreement and a class action waiver, so please read it.

The agreement

THE SHORT VERSION By using OutGeek you agree to these terms and our privacy policy. You must be 18 or older. Disputes go to individual arbitration, not court (section 17).
  • These Terms of Service (“Terms”) are an agreement between you and DNI.Events LLC, doing business as OutGeek Women in Tech (“OutGeek”, “we”, “us”).
  • They cover outgeek.org, OutGeek accounts (free, Plus and team), the job board, newsletters, market and news content, Team of the Year, our events, and any future programs, products or services we offer (the “Services”).
  • By accessing or using the Services, you accept these Terms and our privacy policy (Legal blah blah). If you don’t agree, don’t use the Services.
  • You must be at least 18. If you accept on behalf of a company, you confirm you’re authorised to bind it, and “you” includes that company. In these Terms, a “team” means a company.

What OutGeek is, and isn’t

THE SHORT VERSION OutGeek connects tech talent with hiring teams through a portal, a job board and events. We’re not an employer or recruiter, and we can’t promise anyone a job or a hire.
  • OutGeek is a career and recruiting platform with a focus on women in tech. Everyone working in tech is welcome.
  • We aren’t an employer, employment agency, recruiter or staffing firm, and we aren’t part of any hiring decision. Employers alone decide who they interview and hire.
  • We don’t guarantee that any listing is accurate or still open, or that you’ll get an interview, an offer, a hire or any other result.
  • Market, layoff and press content is for general information only and isn’t financial, legal or career advice.

Accounts and sign-in

THE SHORT VERSION One account per person, or one per company, with true details. No passwords: we email you a sign-in link, so keep your inbox safe.
  • Job seeker accounts sign up with Google using a personal Gmail address. Team accounts sign up with a work email at the company they represent or, if the company email isn’t on Google, with a personal Gmail. Either way, the account belongs to the company, not the person.
  • One job seeker account per person and one team account per company, with one login. A company may let its own colleagues use its team account; how it does that is up to the company, and the company is responsible for everything done from it. Don’t sell or transfer accounts, or share them outside your company.
  • After signing up, you sign in with one-time links we email you. You’re responsible for all activity on your account and for keeping your email secure. Tell us right away if you suspect unauthorised access.
  • Keep your details accurate and up to date. Don’t impersonate anyone or misrepresent your affiliation with any person or company.

Plans, billing and cancelling

THE SHORT VERSION Free stays free. Plus is $3.99 a month and team accounts are $129 a month, billed through Stripe and renewing monthly. Cancel anytime; no refunds for partial months.
  • Free accounts: no charge. We may change or discontinue free features at any time.
  • Plus includes early event access, same-day job alerts shown in your account (not by email) and Team of the Year voting. A team account includes 5 job posts a month, the full team portal, one free team news post and one Team of the Year category.
  • Plus ($3.99/month) and team accounts ($129/month) are subscriptions billed in advance through Stripe. By subscribing, you authorise us to charge your payment method every month until you cancel.
  • Cancel anytime from your account menu (Cancel subscription), which opens the Stripe billing portal. Your plan stays active until the end of the current billing period, and you won’t be charged again.
  • Payments are non-refundable, including for partial months and unused features, except where the law requires otherwise.
  • Prices are in US dollars and exclude taxes, which may be added depending on where you are. We’ll give at least 30 days’ notice by email before a price change applies to you.
  • If a payment fails, we may pause paid features until it’s paid. If you dispute a charge with your bank without contacting us first, we may suspend your account while it’s resolved.
  • We may add, change or remove plan features. We’ll tell you before removing a core feature you pay for.

Job posts

THE SHORT VERSION A team account includes 5 job posts a month. Each post is live for 30 days. Unused posts don’t roll over, and deleted posts still count.
  • Each post includes a role, location, company and a link to the original listing where candidates apply.
  • Posts stay live for 30 days from publishing, then expire automatically.
  • Your 5 posts reset on the 1st of each month. Unused posts don’t roll over. Deleting a post doesn’t return it to your count.
  • Post only real, currently open roles at your company. No placeholder, evergreen, commission-only, pay-to-apply or misleading listings.
  • Posts must comply with employment, pay transparency and anti-discrimination laws where the role is based. Our focus on women in tech doesn’t permit listings that unlawfully exclude anyone.
  • We may edit posts for format, or remove any post that breaks these rules, without refund.

Events

THE SHORT VERSION Events are free for talent, except the last 10 supporter tickets, which help cover costs. Plans can change, photos are taken, and our Code of Conduct applies.
  • Talent tickets are free. The last 10 tickets for each event are paid supporter tickets that help pay for the venue, food, parking for our team and event director fees.
  • Job seekers register through our job seeker Eventbrite page and hiring teams through our employer Eventbrite page. Plus members may get access to spots before they open to everyone.
  • Supporter tickets are refundable only if we cancel the event. Eventbrite’s own fees and refund rules also apply.
  • We may change the venue, date, time, format, speakers or hiring teams, or cancel an event. We’ll tell registered attendees as soon as we can. We aren’t responsible for travel, accommodation or other costs you incur.
  • Registering doesn’t guarantee entry. Venues have capacity limits, and we may refuse entry or remove anyone at our discretion, including for breaking our Code of Conduct.
  • Photos and videos are taken at events. By attending, you allow us to use images of you on our Services, newsletters and social media. Tell the event team, or email us afterwards, if you’d rather not be featured, and we’ll do our best to remove you.
  • Some venues serve alcohol. Drink responsibly and follow local laws, age limits and venue rules.
  • Hiring teams and sponsors are independent of OutGeek. We aren’t responsible for what they say, offer or do.
  • You attend at your own risk. We aren’t responsible for injury, loss or damage to your belongings, except where the law doesn’t allow us to exclude it.

Team of the Year

THE SHORT VERSION Plus and team accounts get one vote per category, including for their own team. One account, one vote. We can remove votes that look fake.
  • Voting opens in August and closes on December 31. Each Plus or team account may vote once per category. Votes are final once cast.
  • Teams may vote for their own team, once per category, from their one team account only. Each vote is recorded against the account that cast it.
  • The 2026 ballot lists the companies OutGeek assigns plus any company that nominates itself. From 2027, the ballot lists only companies that nominate themselves.
  • Extra accounts, bots, asking employees to vote from several accounts, or offering anything in exchange for votes can lead to votes being removed and a team being disqualified.
  • You can change a nomination until someone outside your own team account votes for it; your own vote doesn’t lock it. After that, only we can remove it, for example if it was entered by mistake. Removing a nomination removes its votes and returns the slot at no charge. Votes cast for a removed nomination are not returned to voters. Re-entering a category starts at zero votes.
  • If you cancel your team subscription, your nominations and their votes stay on the ballot until voting closes, but you lose access to your team account.
  • On January 1 each year’s nominees, vote totals and winners are archived and nominations start fresh. Winners are featured on our homepage for the following year.
  • We may change categories, dates or rules, or cancel voting, to keep it fair. Our decision on results is final.
  • Rankings reflect community votes. They aren’t an endorsement by OutGeek or a statement about any company’s employment practices.
  • Nominated and winning teams allow us to use their name, logo and ranking in our Services and marketing.

Your content

THE SHORT VERSION You own what you post. You give us permission to show it on OutGeek and in our newsletters and marketing, and you’re responsible for it.
  • “Your content” means anything you submit: job posts, team news, company names and logos, profile details, feedback and messages.
  • You keep ownership. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, format, display and share it on our Services, newsletters and social media, and in archives and marketing about past events.
  • You confirm you have the rights to everything you submit, and that it’s accurate, lawful and not confidential to anyone else (such as an employer’s internal information).
  • If you send us ideas or feedback, we may use them freely, without paying you.

What you can’t do

THE SHORT VERSION Don’t lie, spam, scrape, harass, discriminate, break the law, or try to break or game OutGeek.
  • Break our Code of Conduct, at events or online.
  • Post false, misleading, discriminatory, defamatory, hateful, obscene or illegal content, or anything that infringes someone else’s rights.
  • Scrape, crawl or copy jobs, attendee information or other content, or use bots or automated tools to access the Services.
  • Resell, republish or commercially reuse our content or member data.
  • Send spam or unsolicited messages to members, or contact them for anything other than professional networking and recruiting.
  • Bully, harass, intimidate or stalk anyone.
  • Upload malware, probe or test our systems for vulnerabilities, bypass security or access limits, or disrupt the Services.
  • Frame the site or use our name or logos without written permission.
  • Do anything that could create liability for OutGeek.

Our content and trademarks

THE SHORT VERSION The site, the OutGeek name and our content belong to us. Other companies’ names and logos belong to them.
  • The Services, including their design, text, graphics, rankings and compilation of jobs and news, are owned by DNI.Events LLC and protected by copyright and trademark law.
  • We give you a personal, non-transferable, revocable right to use the Services for their intended purpose under these Terms. Everything else is reserved.
  • “OutGeek”, “OutGeekWomen” and our logos are our trademarks. Don’t use them without written permission.
  • Other companies’ names, logos and article headlines belong to their owners. Showing them doesn’t mean they endorse us or we endorse them.

Other websites and other users

THE SHORT VERSION When you click through to an employer or article, their rules apply. What happens between you and other members or companies is between you and them.
  • The Services link to third-party sites, including employer job pages, Eventbrite, Stripe and news publishers. We don’t control or endorse them and aren’t responsible for them. Their terms and privacy policies apply.
  • Your dealings with other users, hiring teams, sponsors and venues are solely between you and them. We aren’t obliged to get involved in disputes, though we may choose to.
  • You release OutGeek and our directors, officers, employees, volunteers and agents from claims arising from your interactions with other users, hiring teams, venues or third-party sites, to the extent the law allows.
  • If you’re a California resident, you waive California Civil Code section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Disclaimers

THE SHORT VERSION We work hard to get things right, but the Services are provided “as is”, without promises.
  • THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT.
  • We don’t promise that the Services will meet your career, hiring or business needs, or that they’ll be uninterrupted, secure, error-free or free of harmful code.
  • We don’t verify every job, company, news item or user, and we don’t guarantee the conduct of anyone you meet through OutGeek.
  • Some places don’t allow these exclusions, so some may not apply to you.

Limits on our liability

THE SHORT VERSION If something goes wrong, our responsibility is limited to what you paid us in the last 12 months, or $50 if that’s more.
  • TO THE FULLEST EXTENT ALLOWED BY LAW, OUTGEEK WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OPPORTUNITIES OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US$50. MORE THAN ONE CLAIM WON’T INCREASE THIS LIMIT.
  • Our vendors and service providers have no liability to you under these Terms.
  • Nothing here limits liability that can’t be limited by law, such as for fraud, gross negligence or wilful misconduct, or death or personal injury caused by negligence where that rule applies.

If you cause a claim against us

THE SHORT VERSION If your content, conduct or hiring practices lead to a claim against OutGeek, you cover it.
  • You agree to indemnify and hold harmless OutGeek and our contractors, volunteers, licensees, officers, employees and agents from any third-party claim, loss or cost (including reasonable legal fees) arising from: your use of the Services; your content, including job posts and team news; your hiring decisions or use of attendee data; or your breach of these Terms or the law.
  • We may take control of the defence of any such claim at your expense, and you’ll cooperate. Don’t settle a claim involving us without our written consent.

Suspension and termination

THE SHORT VERSION You can leave anytime. We can suspend or close accounts that break these terms.
  • You can stop using the Services and ask us to delete your account at any time. Cancel any subscription first.
  • We may suspend or terminate your access at any time if you break these Terms, if required by law, or to protect members or the Services, without refund for the current period.
  • We may change, pause or discontinue any part of the Services at any time.
  • Sections that by their nature should survive termination (including payments owed, your content licence, disclaimers, limits on liability, indemnity and dispute resolution) continue to apply.

Disputes and arbitration

THE SHORT VERSION Talk to us first. If we can’t sort it out in 60 days, disputes go to individual arbitration, not court, and not as a class action. You can opt out within 30 days.
  • Informal resolution first: send a Notice of Dispute to hello@outgeek.org with the subject “Notice of Dispute”, describing the claim and what you want. We’ll try to resolve it informally within 60 days.
  • Binding arbitration: if it isn’t resolved, any dispute relating to the Services or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (for individuals) or Commercial Arbitration Rules (for companies), before one neutral arbitrator. Hearings, if any, take place in Sonoma County, California, or by video or phone. Claims under US$10,000 may be decided on written submissions.
  • CLASS ACTION AND JURY WAIVER: YOU AND OUTGEEK WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR TAKE PART IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. CLAIMS MAY ONLY BE BROUGHT INDIVIDUALLY.
  • Exceptions: either party may bring an individual claim in small claims court, or seek emergency injunctive relief in court. Claims for intellectual property infringement, defamation and violations of the Computer Fraud and Abuse Act aren’t subject to arbitration.
  • Opt-out: you may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@outgeek.org with the subject “Arbitration opt-out” and your name and account email.
  • Arbitration is confidential. Each party pays its own legal fees unless the arbitrator decides otherwise or the law requires otherwise.
  • Any court proceedings permitted under these Terms will take place in the state or federal courts of Sonoma County, California.
  • If the class action waiver is found unenforceable for a claim, that claim goes to court rather than arbitration. If any other part of this section is unenforceable, the rest still applies.

General

THE SHORT VERSION California law applies. We can update these terms with notice. These terms and our privacy policy are the whole agreement.
  • Governing law: these Terms are governed by the laws of California, USA, without regard to conflict-of-law rules, except where your local consumer laws give you rights that can’t be waived.
  • Changes: we may update these Terms. For material changes we’ll email account holders and post a notice on the site. Changes take effect 30 days after notice for existing users and immediately for new users. Continuing to use the Services after that means you accept them.
  • Electronic communications: you agree to receive notices, agreements and other communications from us electronically, and that they satisfy any legal requirement to be in writing.
  • Entire agreement: these Terms, our privacy policy and any order or booking terms you accept make up the whole agreement between you and OutGeek about the Services.
  • No waiver: if we don’t enforce a right, we haven’t waived it. If a provision is unenforceable, it’s modified to the minimum extent needed and the rest still applies.
  • Assignment: you can’t transfer these Terms without our written consent. We may assign them, for example as part of a merger or sale.
  • Events beyond our control: we aren’t liable for delays or failures caused by events we can’t reasonably control, such as weather, strikes, outages, illness, venue problems or public health rules.
  • No partnership: nothing in these Terms creates a partnership, joint venture, employment or agency relationship.
  • Export: you’ll comply with US and other applicable export and sanctions laws when using the Services.
  • Headings are for convenience only. “Including” means “including without limitation”.
